Commercial Services

The Commercial Team can provide general Commercial support to SPVs in areas such as; Settlement Negotiation, Contractual Dispute and Contract Change in addition to the services listed below. The Commercial Team are made up of Quantity Surveyors, Building Surveyors, FM Experts and Project Managers. This mix allows the team to offer a diverse range of services covering all aspects of PFI.

James Burbidge

Commercial Consultancy Director

A commercially-focused Chartered Accountant with exposure across a range of sectors including over 10 years managing infrastructure projects, with particular experience in business growth, strategic reviews and driving change.

Helen Shepherd

Commercial Finance Manager

A commercially-focused Certified Chartered Accountant with experience across a variety of infrastructure projects delivering activities such as dispute resolution, managing and contractually pricing variations and the liquidation / change in Service Provider. They apply their background as a Forensic Accountant to carry out the review, analysis and interpretation of contractual documentation and financial information.

Nigel Dale

Commercial Manager

Nigel is a Chartered Quantity Surveyor with a Post Graduate Diploma in Arbitration. He has extensive knowledge and experience in the risk allocation and contractual relationships in PFI. His particular expertise is in negotiating agreements and trying to avoid disputes, but those too, including adjudication. This includes operational FM and Payment Mechanisms He has been involved in PFI since 1997 when with Taylor Woodrow he worked on Sheffield Council’s ‘One-Stop Shop’ in the city centre, compiling the price and commercial aspects of the FM bid. Since this time he worked for Amey on the Centrica FM contract, FM bids for Carilion (PFI Health – included John Radcliffe, Oxford and Queen Alexandra, Portsmouth), before being recruited to Kier Project Investment, compiling bids for Project Co in the health, schools, police and fire sectors. He joined HCP in 2013 and has been resolving commercial and contractual issues since this time including settlement agreements (e.g. transferring responsibility for IT to a Trust) and contractual wrangles of ‘all shapes and sizes’; currently (Dec 18) how the ‘RMC’ process is supposed to work on a healthcare project and the quantum and enforcement of Deductions on a schools project that has just been submitted to adjudication.

Jonathan Todd

Commercial Manager

25 years’ commercial experience on a diverse range of integrated Public Private Partnership Design, Build, Finance and Operate projects.

Jonathan has Managed all aspects of Project Company commercial and contractual obligations from initial feasibility studies to handback, developing and delivering strategies, strengthening returns from; stakeholder negotiations, procurement optimisation, variations delivery, disputes, insurance claims and land transactions. Focusing on minimising risks, maintaining and strengthening relationships, delivering commercial support to project companies at critical times.

Ian Sayers

Commercial Manager

Commercial manager specialising in PFI Health Sector & Education contract drafting with over eight years’ experience working for Service Provider, Project Co, and Client side. Experienced in working on payment mechanism, dispute resolution procedure, operational protocols, contract deliverables, Benchmarking, and Market Testing, Ian offers a broad range of PFI commercial guidance.

Roger Lancaster

Commercial Manager

A Commercial Manager with over fifteen years’ experience in the facilities management industry in commercial and business development roles covering hard and soft FM, and PFI projects for various large FM service providers. Roger’s skillset includes understanding of how FM services are designed, sold, implemented and delivered; with knowledge and experience of standard from PFI contract documents. He appreciates the importance of commercial governance, being able to anticipate clients changing needs and concerns, and developing innovative solutions that provide meaningful benefits and outcomes for clients.

John Roberts

Commercial Manager

Over 25 years’ experience, both pre and post contract on a diverse portfolio of PFI, PPP and traditionally procured hard and soft facilities management, ICT services and construction contracts.

John has commercially managed all aspects of major contracts including bidding, mobilisation, operational commercial contract management and final accounts. Experienced in negotiation, contract reviews, contract deliverables, dispute avoidance and resolution, PFI and non PFI payment mechanisms, supplier procurement, major variations, risk and opportunities management and contract administration.
